Possible uncertainty with developers doesn't stop NHDES from implementing revised CSPA rules. The New Hampshire Department of Environmental Services announced that it is preparing to implement the revised Comprehensive Shoreland Protection Act rules effective April 1, 2008. It understands doing so may create uncertainty for development projects as the legislature is currently considering a bill that could later change that effective date. More clarification is expected, but it appears projects started after summer 2007 will possibly need to be submitted following the new rules. Whether a project has “vested” rights to follow the old rules depends on the effort expended into the design, how far in the past the work took place, and whether a project can be made to comply with the new regulations.
Stay tuned for more information, or click here, or contact Robert Cormier at 603-882-1812.
